GENERAL TERMS AND CONDITIONS

1. Subject matter

TropeaBooking is a trademark of the Travel Consortium Pro Santa Maria - Capo Vaticano (hereinafter “the Consortium”). Through its Website www.tropeabooking.it (hereinafter “the Website”), the Consortium intends to develop and promote the splendid holiday area around Tropea, Capo Vaticano and Santa Maria di Ricadi with the objective of suggesting new itineraries, pointing out products and services of the associated enterprises, offer assistance and customized solutions for theme holidays and thematic trips, tours, meetings, congresses and incentives. The present act defines the Terms and Conditions applied by the Consortium regarding the acquisition of travel and accomodation services by the user (hereinafter „the User“) through the Website. Prior to the acquisition of the above mentioned travel services, the User agrees to accept these Terms and Conditions. The Consortium primarily verifies the availability of accommodation within the associated structures and subsequently makes these products and services available to the User according to the legal regulations and the conditions applicable to each individual service provider.

2. Type of Services

Through the Website, the User can acquire accomodation services according to the offers provided and publicated by the associated structures.

3. Contractual Partys

The acquisition of the accomodation services (as defined above) constitutes a Contract between the User and the provider of the said services. The provider is defined as the structure promoting its offers throught the Website. The General Terms and Conditions of each individual provider are available for the User on the Website.

4. Liability

The Consortium acts as intermediary for the acquisition of accomodation services. Consequently, it can not be held liable for any non-performance or poor performance of the obligations in charge of the providers of the travel or accomodation services.

5. Information published on the Website

The Consortium undertakes to use its best endeavours to guarantee the accuracy and timeliness of the information published on the Website with regard to the offered services. Notwithstanding the foregoing, the information published on the Website is supplied by the individual service providers. According to applicable law, the Consortium therefore cannot be held liable for the correctness and precision of this information. Before carrying out an acquisition, the User undertakes to verify together with the service provider the published information regarding the desired accomodation service.

6. Conditions regarding the acquisition of accomodation services

6.1 The acquisition of an accomodation service
The acquisition of an accomodation service is carried out by the User throuh the Website. The User supplies his personal data (first and last name, e-mail, etc.) and his credit card details. Within 48 hours after the Consortium having received the confirmation of the bank regarding the existence of funds on the User’s credit card, the User receives a confirmation mail of the Consortium including a detailed copy of the acquired services. These details can also be checked on the personal profile page of the User available on the Website (“My accomodations”). In case of errors in these booking details, the User undertakes to immediately call the client support under the number indicated in the confirmation e-mail.

6.2 Payment Conditions
At the time of selection of the desired accomodation service, the User has to pay a deposit of 30% of the total accomodation costs by credit card. The balance is due on arrival or departure directly to the provider of the accomodation service. During the acquisition process, the User will be asked for his credit card details; in case of problems regarding the payment (e.g. non-authorization of the payment on the part of the bank), the acquisition process will be stopped free of charge for the User. 6.3 Special offers and Restrictions
The offers published on the Website are subject to availability. At the moment of the provision of the credit card details by the User, only the available offers will be displayed on the Website. For possible further restrictions please consult the detailed description of the offer on the Website.

6.4 Prices
The prices of the individual accomodation services offered on the Website are subject to seasonal or other variations to allow the intermediary to offer the User the most competitive price. The price depends on various factors like:
1) acquisition date; 
2) category of the chosen hotel;
3) departure date; 
4) period of stay; 
5) stay on weekends; 
6) etc. 
The User can check the availability of the accomodation service offered on the Website and the current price before carrying out the definite booking. However, there may be charged additional fees or taxes not indicated nor included in the sales price.

7. Modification requests on the part of the User

In case of modification requests regarding the acquired accomodation service, please call the Client Support under the telephone number indicated in the confirmation e-mail. The Travel Consortium undertakes to use its best endeavours to satisfy the User’s modification requests, although not being able to guarantee the performance of such modifications. If the User asks for the provision of special or additional services, those services will be provided –if possible- by the provider of the accomodation service and charged to the User’s account at arrival or departure (depending on the nature of this special or additional service). The User will however be informed about the amount of such extra costs when placing the respective order with the service provider or the client support. Possible additional accomodation services will be assessed on demand.

8. Modification and Cancellation of the accomodation services

In the case of Purchase of accomodation services, the User acknowledges that the individual service provider can any time make changes. Although the Consortium is not liable for the total or partial non-performance of the accomodation or other services offered on the Website, it will inform the User in writing via e-mail about the type of modification according to the information received from the provider of the accomodation service (e.g. changes regarding the check-in time). Any refund of amounts paid by the User will be decided in accordance with the regulations or laws applicable to the concerned service provider. Furthermore, the Consortium is not obliged to pay for any damages arising from cancellations or modifications to the Accomodation Services due to reasons of force majeure. Such events include but are not limited to: war, terrorist activity, national strikes, fires, epidemics, hurricanes and other actual or potential environmental disasters.

9. Withdrawal

Under Article 55, first paragraph, letter of the Italian Consumer Code, the right of withdrawal does not apply to contracts relating to the accomodation services bookable on the Website, when on concluding the contract the service provider agrees to provide these services on a specific date or within a fixed period.

10. Force Majeure

In cases of cancellations and/or modifications by the User due to force majeure, any refunds of amounts paid by the User will be decided in accordance with the regulations or laws applicable to each service provider. For example, the possibility or the extent of reimbursement of the hotel costs will depend on the terms of cancellation applied by each hotel.

11. Complaints

Any dispute concerning the execution of the contract must be submitted by the User without delay directly to the providers of services to guarantee a prompt remedy. The User also undertakes to submit any complaint not later than ten working days from the date of his return from holidays to the providers of services by registered mail with copy to the Consortium.

12. Governing Law

This contract is subject to Italian law excluding the applicability of the law 218/95 on "Reform of the Italian system of Private International Law" . Moreover, it is subject to the CCV [1] and to the provisions of Title III, Chapter I, Section II of the Italian Consumer Code ("Distance Contracts").

13. Personal Data

The personal information of the User will be treated as described in our Privacy Statement accepted at the time of purchase and / or registration on the Website.

14. Conditions for use of the Website

The website www.tropeabooking.it is an online information service provided by the Travel Consortium Pro Santa Maria - Capo Vaticano. Its use is subject to acceptance of the Terms and Conditions set forth herein. If you do not agree with these Terms and Conditions, you are requested not to use the Website or download any materials from it.
